OHHA Board Meeting Minutes
OHHA Office, Columbus, Ohio---April 21, 2009
OHHA President Steve McCoy called the meeting to order at 1:00pm
The following Directors and Employees were in attendance: Jim Arledge Jr., Roy Burns, Robert Cain, Senena Esty, Joe Ewing, Kevin Greenfield, Randy Haines, Amy Hollar, Don “Skip” Hoovler, Jerry Knappenberger, Suanne Kochilla, John Konesky III, Rick Martindale, Steve McCoy, Dr. John Mossbarger, Linda Nance, William Nibert, Sam Noble III, John Poppe, Kim Rinker, Dayle Roof, Betty Shaw, Daryl Sherman, and Brad Wallace.
Motion made by Rick Martindale for approval of January 16, 2009 Board meeting minutes was seconded by John Konesky III, motion passed.
Daryl Sherman gave the financial report, stating this was only three months into the new year. The track income was down by $7,800.00 with Lebanon having the biggest loss of revenue at this time. He said miscellaneous income showing an increase of $4,600.00 for membership dues may need to be adjusted for unearned revenue. Which would be an overall decrease of $3,100.00 in unrestricted revenue.
Administrative expenses are down for year to date by $2,800.00, while membership expenses are also down $31,000.00 due to changes of personnel. Other activities such as advertising are down due to the February magazine not having the stakes advertising, with all stakes being included in the OSRC booklet. The decrease in net assets year to date is $33,300.00. Jerry Knappenberger stated the OSRC stakes book was combined this year into one book for the benefit of OHHA membership, also that this booklet is on the OHHA website. Ohio Breeders Stake listed on the balance sheet will be paid out when the race is completed.
Steve McCoy asked if anyone has heard comments about the Sires Stake booklet being combined this year. Jerry Knappenberger stated the OSRC, used a handicapped group, for mailing this booklet, whose facility was closed unexpectedly for over a week, which caused some membership not to receive the booklet until after the February 15th deadline. The OSRC has stated this problem will not exist next year. John Konesky stated the book was a great idea but, some forms were confusing, idea of Delaware putting sustaining sheet with nomination sheet. Betty Shaw stated the forms and list needs to be together. Jerry Knappenberger stated he will work with Delaware to correct forms.
Dayle Roof reported on the Health Insurance Trust stating the renewal date will be in July. In one week the liability for claims was $36,000. The trustees may have to look into changing benefits. Need to encourage sign ups at the tracks. Dayle to report back to the Board, after The OHHHIT meeting in July. Steve McCoy stated the benefits of the OHHHIT health program are better than benefits in surrounding states.
Rick Martindale gave the banquet committee report, stating they approved Jerry Knappenberger to sign the contract with the Columbus Marriott, Northwest for 2010 banquet. The committee suggested charging a director who made reservations who does not show or call to cancel before final deadline. Also discussed was the directors calling in the day of meetings to cancel when lunch reservations must be guaranteed prior to the meeting, this is costing the OHHA unnecessary expenses. Motion was made by Dr. John Mossbarger to charge directors who do not cancel banquet reservations before final deadline and seconded by Senena Esty, motion passed.
Bob Schmitz spoke on expanded gaming, stating at this time the OSRC proposal has not been processed into a bill. It is unlikely the proposal will be put into the budget bill and currently it is not known what the splits of the money will be. The OSRC proposal would not need a vote of the people if the proposal goes through the lottery commission. The Governor must be for the proposal or nothing will happen. Bob’s suggestion at this time is to talk with the Governor and send letters and emails to legislators. There are several outlines in the packet with information and on the OHHA website.
Bob also discussed the Penn Gaming/Gilbert/My Ohio Ballot Issue stating the original petition language was turned down by the Attorney General, but since has been approved and now the group can begin to collect the over 400,000 signatures needed to place the issue on the ballot. Bob does not see the Governor embracing casinos in four major cities.
Jerry Knappenberger discussed the HHI annual meeting. He stated HHI reviewed the current situation on ADW’s and with nothing being accomplished by the THG at this time, HHI felt there was little that could be done without federal legislation. Jerry was re-appointed to the board of directors. The HHI fire & disaster / third party liability programs are in packet.
Skip Hoovler reviewed the USTA meeting and stated the whipping rule change was adopted and will be enforced where USTA rules are used.
Jerry Knappenberger discussed the OSRC Safety Committee meeting. He stated the committee took no formal action on a whipping rule change at this time. Jim Arledge stated the betting public is complaining about whipping rules in Indiana. Jerry discussed the commission’s reluctance to adopt a rule which would provide a waiver for races being contested if no outrider is present during the race.
Jerry gave an update on Anabolic Steroid testing, stating there are currently seven positives and all have received warnings at this time. The OSRC testing program is now in the penalty phase. RCI has announced proposed penalties for all drug testing and there will be medication committee meetings before enacting new rules in Ohio. Throughbred horsemen have questioned high positives and testing machine results. Requesting to be allowed to race and re- test after race with penalties. He stated he is working with the ORC to provide steroid testing for new horses coming from other jurisdictions or changing trainers to provide an opportunity to have the horse tested at the owners expense before racing the horse and risking a positive.
Dr. John Mossbarger stated OEIC was attempting to put together a legislative day, John will update when information is received. He discussed the horse slaughter bill, stating the bill is in house on the federal level, preventing hauling horses to Canada and Mexico for slaughter. American Humane Society is trying to ban eating red meat making livestock industry harder to manage.
In discussing the ODA Equine Industry Task Force, John said that group urged the Director of Agriculture to support the OSRC proposal for expanded gaming. The Task Force has recognized OEIC as the unified equine voice for Ohio. John stated the Task Force is considering a bag feed check off to fund marketing for the equine industry. Bob Cain stated this is very hard to track which feed goes where and feels this is not equitable for a feed check off. Motioned by Daryl Sherman for OHHA to write a letter opposing the proposal of the horse slaughter bill second by Betty Shaw, motion passed.
Jerry Knappenberger discussed the Ohio Breeders Stake stating the purses should be about $16,000-$17,000 for 2yo, $14,000-$15,000 for 3yo, all sustaining payments have been received at this time, and feels all divisions should be filled.
Jerry Knappenberger and Joe Ewing reported on OHHA regional meetings, stating there were five regional meetings with Northfield having the largest turnout with approximately fifty people in attendance and could have had more in meeting if held in larger area. Suanne Kochilla stated she thought the meetings were very positive with horsemen and OHHA. Joe Ewing discussed the OFMA/OHHA Fair Advisory Committee meetings. He stated the group will continue to meet and work to enhance Ohio fair racing, stating some of the future items to be discussed are fair manual, one call in number for races, reduction of circuits and marketing.
Jerry Knappenberger reported on the On-Track accident insurance stating that racetracks must provide medical coverage at least equal to their average daily purse. Therefore Ohio racetracks, having $50,000 medical coverage are in compliance. He stated he had received a request from Northfield Park that the AD&D insurance be increased from $50,000 to $100,000. In researching the cost to increase AD&D and/or medical coverage, he discovered the cost would be very equitable. He stated increasing the medical coverage would be more beneficial to horsemen in most cases, but suggested the increase in both medical and AD&D would be a very good benefit in relation to cost. Steve McCoy suggested increasing both AD&D and medical at all four tracks and sharing the cost of the AD&D with the tracks. Motion made by Jim Arledge for OHHA to change coverage from $50,000 to $100,000 seconded by Dayle Roof. Motion passed.
Skip Hoovler made a motion on AD & D to split the cost with the track if not shared decline the increase and motion was seconded by Suanne Kochilla. Motion passed.
Jerry Knappenberger gave an update on horsemen’s purse pools. Lebanon purses will increase with next condition sheet. Northfield purse account is overpaid but going to three days of racing in the middle of May will allow the purse pool to become underpaid. Raceway Park purse pool is in good shape at this time and will begin the meet with a $100 per race purse increase. Throughbred handle is down more than standardbred racing in the state at this time. He said the Scioto Downs track committee met to discuss purses and had raised purses about 15% per day to begin the meet.
Misc. Steve McCoy appointed an Ad-Hoc Committee to study a possible name change of OHHA and report to the board. Those appointed to the committee are Senena Esty, Sandy Beatty, Betty Shaw, Dayle Roof and Skip Hoovler.
Roy Burns presented the Trainer/Driver Section report. He said the section request that OHHA track representatives, being part time, should be able to be listed as the trainer of horses, but must be on the job at home track. Motion made by Skip Hoovler to change OHHA policy if permitted with OSRC and racetrack management to allow part time employees to be listed trainer, seconded by Senena Esty. Motion Passed.
Suanne Kochilla gave Owners Section report, stating everyone needs to talk with membership and encourage them to write letters or e mails to their state legislators regarding passing OSRC proposal. Suanne also stated that having OHHA regional meetings was a great idea so the membership can visibly see OHHA involvement. Senena Esty gave Breeder Section report, stating the 2007 auction has collected $11,989 with $2,175 remaining and the 2008 auction bid was $20,475 with $13,570 remaining and 2009 bids are $11,700 with $9,240 remaining. OHHA collected $1,044 for 2009 Stallion Directory from the Horseman & Fair World and said they could not continue to publish the book if they can not realize a profit of at least $2,000. A booklet is in the packet showing the decline in breeding. Jerry Knappen- berger gave Raceway Park report stating management has made several facility improvements and are continuing to offer many promotions to patrons. They will race a total of 60 days in 2009.
Jerry also gave Lebanon Raceway and Scioto Downs report with Lebanon being down just 2.3% in mutuel handle. They will have an early post time for Kentucky Derby day, the Preakness and the Belmont which should help increase revenue. Scioto Downs added qualifying races for Friday April, 24th.
Amy Hollar gave Northfield Park report saying they are currently racing 4 days per week and will go to 3 days per week in the middle of May.
